Consultmed is a user-friendly referral management and automated workflow platform that connects primary health care providers (e.g. general practitioners) directly to secondary health care providers (e.g. specialists, clinics and hospital networks). It is a cloud-hosted platform that is accessible at https://app.consultmed.co (including any subdomains) or by any online portal, site or platform approved by Consultmed which utilises the public-facing or provider-facing platform; and Consultlink, is a specialised platform within Consultmed’s ecosystem, focused on facilitating consults, advice & guidance or e-consults. Powered by Consultmed’s core referral management software, Consultlink empowers primary care providers to seek specialist opinions or engage in consults using asynchronous messaging technology. It is also a cloud-hosted platform, available for access at https://app.consultlink.co (including any subdomains), or through any online portal, site, or platform approved by Consultmed that utilises the public-facing or provider-facing platform (“Platform”).

The Platform uses third party links, services and plug-ins as part of the delivery of the Platform, products and services (“Third Party Services”). This may include Microsoft’s Azure OpenAI Service (“Azure OpenAI Service”), if the ConsultPilot AI add-on is accessible to the User. By using the Platform, you acknowledge and agree that you have reviewed Azure OpenAI Service’s terms (available at: https://www.microsoft.com/licensing/terms/productoffering/MicrosoftAzure/MCA#ServiceSpecificTerms) and agree to be bound by them, and have reviewed its data, privacy, and security policy (available at: https://learn.microsoft.com/en-us/legal/cognitive-services/openai/data-privacy?tabs=azure-portal).

ConsultPilot AI” is the Azure OpenAI Service powered optional add-on to the Platform used to convert unstructured or semi-structured data, including but not limited to paper documents, PDFs, and other non-digital formats, into structured data that can be easily accessed, analysed, and utilised in the Platform (“Transform”, “Transformation”) to assist the User to enter information to the Platform, including for the purpose of creating Referrals and Advice & Guidance.

For the purposes of this Privacy Policy, “Transform” means the process of converting unstructured or semi-structured data, including but not limited to paper documents, PDFs, and other non-digital formats, into structured data that can be easily accessed, analysed, and utilised in the Platform. This process involves the application of advanced artificial intelligence technologies to extract relevant information, standardise data formats, and automatically structure and input the data into the Platform, and “Transformation” shall have the same meaning.

ConsultX Pty Ltd (ACN 641 890 324) trading as Consultmed (“Consultmed”) and Consultlink Pty Ltd (ACN 661 722 578) trading as Consultlink (“Consultlink”) and any wholly or partly owned subsidiaries of Consultmed and/or Consultlink (“us”, “we”, “our”) is committed to privacy protection. At www.consultmed.co (“Website“), we understand the importance of keeping personal information private and secure. This privacy policy (“Privacy Policy“) describes generally how we manage personal information and safeguard privacy. If you would like more information, please don’t hesitate to contact us.

Please read this Privacy Policy carefully. By accessing and using our Platform, Consultpilot AI, our products and Services, you agree and consent to the collection, usage, storage and disclosure of personal and health information by us as set out below.

This Privacy Policy forms part of, and is subject to the provisions of, our Website Terms and Conditions located at https://www.consultmed.co/terms-of-service/ (“Terms“).

Capitalised terms which are not defined in this Privacy Policy shall have the same meanings as defined in our Terms.

  • We will never rent, trade, or sell your personal information to any third party.
  • We will not publicly disclose any personally identifiable information outside of the intended purposes of this Platform, except as required by law or with your explicit consent.

 

The Australian Privacy Principles


We will treat all personal information in accordance with any and all obligations that are binding upon us under the Privacy Act 1988 (Cth) (“Privacy Act”). The Privacy Act lays down 13 key principles in relation to the collection and treatment of personal information, which are called the “Australian Privacy Principles”.

Who this applies to


In this Privacy Policy, “you” and “Users” means:

  • a carer who provides care and support to a Patient (“Carer”);
  • primary or secondary healthcare providers or any Carers using the Platform to refer Patients, or any Patients referring themselves (“Referrers”);
  • secondary health care providers that receive Referrals for Patients from primary health care providers via the Platform (“Receivers”);
  • secondary health care providers that receive Referrals for Patients from primary health care providers via the External Platform (“External Receivers“);
  • primary or secondary health care providers or Patients using the External Platform for Referrals (“External Referrers“);
  • Patients who are referred via the Platform (“Patients”); and/or
  • any other person who browses the Website or registers to use the Platform or the Services.

What is “personal information”?


Personal information” is information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether true or not, and whether recorded in a material form or not. Personal information held by us may include:

for Referrers and Receivers, without limitation, the following:

  • full name;
  • primary and secondary places of work;
  • work email address;
  • telephone number;
  • work address;
  • details of any specialist practice, qualifications and industry body memberships relevant to the Referrer or Receiver;
  • Medicare provider numbers;
  • AHPRA registration or other Professional association number;
  • details of the products and services we have provided to you or that you have enquired about, including any additional information necessary to deliver those products and services and respond to your enquiries;
  • any additional information relating to you that you provide to us directly through our website or indirectly through your use of our website or online presence or through other websites or accounts from which you permit us to collect information;
  • information you provide to us through customer surveys;
  • billing information; and
  • any other personal information that may be required in order to facilitate your dealings with us.

and for Patients and/or Carers, includes any Health Information which means:

  • information or an opinion about:
    • the health, including any illness, disability or injury, (at any time) of an individual;
    • an individual’s expressed wishes about the future provision of health services to him or her;
    • a health service provided, or to be provided, to an individual;

and that is also personal information;

  • other personal information collected to provide, or in providing a health service to an individual. This includes personal details such as a patient’s name, address, admission and discharge dates, billing information and Medicare number; and
  • genetic information about an individual in a form that is, or could be, predictive of the health of that individual or a genetic relative of the individual.

The types of Health Information we collect in relation to Patients and/or Carers include:

  • full name;
  • date of birth;
  • Medicare number;
  • health fund details;
  • Carer and guardian details;
  • medical history and details of any current illness, injury or condition of the Patient and/or Carer;
  • health services to be provided;
  • primary and secondary diagnoses and presenting complaints;
  • primary reason for referral to secondary care providers ‘Receivers’;
  • social and background history;
  • past medical history;
  • past mental health and psychiatric history;
  • family history,
  • list of current medications;
  • list of current allergies;
  • other specific health information that a Receiver requires from the Referrer in order to accept a referral; and
  • other information that the Referrer, Receiver, Patient and/or Carer deems relevant.

We comply with the Health Insurance Act 1973 (Cth) and Health Insurance Regulations 1975 (Cth) by collecting all information required to make any referral made via the Platform legally valid and able to be billed via Medicare.

Information provided to payment gateway providers?

All purchases that are made through this Platform are processed securely and externally by one or more third-party payment gateway providers (i.e. Stripe, etc). Unless you expressly consent otherwise, we do not see or have access to any personal information that you may provide to such third-party payment gateway providers, other than information that is required in order to process your order (e.g., your name, phone number, email address and billing address).

How we may collect your personal information


On this Platform, we only collect personal information that is necessary for us to provide our products and service, and it collected through fair and lawful means, ensuring the process is not unreasonably intrusive. We are committed to maintaining transparency in how we collect your personal information and ensure that it is done in a manner that respects your privacy. Our collection practices are designed to minimise any inconvenience or intrusion, and we strive to handle all personal information with the utmost care, in compliance with applicable privacy laws and regulations.

Personal information

We may collect personal information that you provide to us about yourself in the following circumstances including (but not limited to):

  • Account Registration: When Referrers or Receivers register on the Platform, they provide us with personal information which is required to create an account. This information helps us provide personalised services, communicate updates, and offer support.
  • Referral Upload: When Referrers upload a referral onto the Platform (manually or via Consultpilot AI), they provide certain information about themselves and the Patient. This may include their professional details and any relevant information that would facilitate the referral process.
  • Advice & Guidance Upload: When Referrers upload a request for Advice & Guidance onto the Platform (manually or via Consultpilot AI), they provide certain information about themselves and the Patient. This may include their professional details and any relevant information that would facilitate the consultation process.
  • Accessing Referrals: When Receivers access the platform to review a referral, they may need to input or confirm certain personal details to ensure a smooth and secure referral process.
  • Accessing Advice & Guidance requests: When Receivers access the platform to review a request for Advice & Guidance, they may need to input or confirm certain personal details to ensure a smooth and secure consultation process.
  • Pre-populating Patient Information: In collaboration with third-party providers, we collect information when Referrers pre-populate patient information in a referral or Advice & Guidance (for example via Consultpilot AI). This is done to streamline the referral and Advice & Guidance process and ensure the accuracy of the information provided.
  • Updating Information: When Referrers or Receivers update patient or provider information on the platform (manually or via Consultpilot AI), we collect and store these changes to maintain up-to-date and accurate records.
  • Patient and/or Carer Consent: When Patients and/or Carers provide their consent through the platform as requested by Referrers or Receivers, we collect and document this consent. This consent is usually provided when Referrers or Receivers input Patient details onto the platform, signifying that the Patient agrees to the sharing of their information for referral and Advice & Guidance purposes.
  • Customer Support Interactions: Consultmed may collect personal information when Referrers, Receivers, or Patients and/or Carers interact with our customer support team, either through email, over the phone, or via online chat. This information is used to provide assistance, resolve issues, and improve our services.
  • User Surveys and Feedback: Consultmed may conduct surveys or request feedback to understand user experience and improve our platform. Personal information might be collected during these interactions.
  • Marketing Activities: Consultmed may collect personal information during promotional activities or events, such as webinars or online conferences, for the purposes of marketing communication.
  • We may also collect personal information from you when you fill in an application form, communicate with us, visit our website, provide us with feedback or complete online surveys.

Health information

We collect health information primarily when a new Patient is registered for referral or Advice & Guidance via our Platform.

The key circumstances under which we collect sensitive health information include (without limitation):

  • Patient and/or Carer Registration: When Patients and/or Carers are registered on the Platform (manually or via Consultpilot AI), health information is entered into the system. This may include medical history, diagnostic information, prescribed medications, allergies, and other pertinent medical data.
  • Referral Uploads: When Referrers upload a referral onto the Platform (manually or via Consultpilot AI), they provide detailed health information about the Patient. This information enables Receivers to understand the Patient’s health status and provide appropriate care.
  • Advice & Guidance Upload: When Referrers upload a request for Advice & Guidance onto the Platform (manually or via Consulpilot AI), they provide certain information about themselves and the Patient. This may include their professional details and any relevant information that would facilitate the consultation process.
  • Accessing Advice & Guidance Requests: When Receivers access the platform to review a request for Advice & Guidance, they may need to input or confirm certain personal details to ensure a smooth and secure consultation process.
  • Pre-populating Patient Information: We collect health information when Referrers pre-populate patient information in a referral or consult, which is done in collaboration with third-party providers (for example via Consultpilot AI). The information helps streamline the referral and Advice & Guidance process and enhance the accuracy of Patient’s health data.
  • Attaching Additional Health Information: Receivers might attach third-party investigations, test results, or other health information to a Report (manually or via Consultpilot AI). This additional information can provide a more comprehensive view of the Patient’s health status.
  • Adding Exogenous Referrals: Receivers may manually add an exogenous referral to the Platform (manually or via Consultpilot AI), which could contain sensitive health information about the Patient.
  • Updating Health Information: When Referrers or Receivers update a Patient’s health information on the Platform (manually or via Consultpilot AI), we collect these changes. This might include updates to diagnoses, treatment plans, or medication changes.
  • Telemedicine Interactions: If telemedicine services are utilised where Patients and/or Carers, Referrers, or Receivers can conduct virtual consultations, we collect health information disclosed during these sessions. This may encompass discussed symptoms, provided diagnoses, proposed treatments, or any notes taken during the consultation.
  • Automated Data Import: Our Platform has the capability to automatically import health data from compatible electronic health records systems, digital health devices, or health tracking applications, provided that the Patient has granted consent for this data sharing.
  • Consent Forms and Agreements: Digital consent forms or agreements signed by Patients and/or Carers for specific treatments or procedures often contain health information, which is then collected and stored securely on our Platform.
  • Communication Between Referrers and Receivers: We collect health information shared in the course of communications between Referrers and Receivers on the Platform. This may include messages, notes, or comments relating to the Patient’s health.
  • Attaching Additional Health Information: Referrers, Receivers or Patients and/or Carers may attach third-party investigations, test results, or other health information to a Report (manually or via Consultpilot AI) to provide a comprehensive view of the Patient’s health status.
  • Updating Health Information: We collect changes to a Patient’s health data when Referrers or Receivers update this information on the Platform (manually or via Consultpilot AI). This could for instance encompass modifications to patient details, diagnoses, treatment plans, or medication changes.
  • Patient Self-Reported Information: Our Platform allows Patients and/or Carers to voluntarily provide additional health information, such as symptoms, lifestyle habits, or personal health goals (manually or via Consultpilot AI). This self-reported information is collected and integrated into their health profile.

We handle all sensitive health information with care and ensure compliance with applicable laws and regulations.

IP addresses

This Platform may also collect Internet Protocol (IP) addresses. IP addresses are assigned to computers on the internet to uniquely identify them within the global network. We collect and manages IP addresses as part of the service of providing internet session management and for security purposes. We may also collect and use web log, computer and connection information for security purposes and to help prevent and detect any misuse of, or fraudulent activities involving, this Platform.

Cookies


This Platform uses “cookies” to help personalise your online experience. A cookie is a text file or a packet of information that is placed on your hard disk by a web page server to identify and interact more effectively with your computer. There are two types of cookies that may be used at this Platform: a persistent cookie and a session cookie. A persistent cookie is entered by your web browser into the “Cookies” folder on your computer and remains in that folder after you close your browser, and may be used by your browser on subsequent visits to this Platform. A session cookie is held temporarily in your computer’s memory and disappears after you close your browser or shut down your computer. Cookies cannot be used to run programs. Cookies are uniquely assigned to you, and can only be read by a web server in the domain that issued the cookie to you. In some cases, cookies may collect and store personal information about you. Cosultmed extends the same privacy protection to your personal information, whether gathered via cookies or from other sources.

You can configure your internet browser to accept all cookies, reject all cookies or notify you when a cookie is sent. Please refer to your internet browser’s instructions to learn more about these functions. Most web browsers automatically accept cookies, but you can usually modify your browser settings to decline cookies if you prefer. If you choose to decline cookies, you may not be able to fully experience the interactive features of this Platform.

Why we use cookies

This Platform uses cookies in order to:

  • remember your preferences for using this Platform;
  • manage the signup process when you create an account with us;
  • recognise you as logged in while you remain so. This avoids your having to log in again every time you visit a new page;
  • facilitate e-commerce transactions, to ensure that your order is remembered between pages during the checkout process;
  • show relevant notifications to you (e.g. notifications that are relevant only to users who have, or have not, created an account or subscribed to newsletters or email or other subscription services); and
  • remember details of data that you choose to submit to us (e.g. through online contact forms or by way of comments, forum posts, chat room messages, reviews, ratings, etc).

Many of these cookies are removed or cleared when you log out but some may remain so that your preferences are remembered for future sessions.

Third party cookies

In some cases, third parties may place cookies through this Platform. For example:

  • Google Analytics, one of the most widespread and trusted website analytics solutions, may use cookies de-identified data about how long users spend on this Platform and the pages that they visit;
  • Google AdSense, one of the most widespread and trusted website advertising solutions, may use cookies to serve more relevant advertisements across the web and limit the number of times that a particular advertisement is shown to you; and
  • third party social media applications (e.g., Facebook, Twitter, LinkedIn, Pinterest, YouTube, Instagram, etc) may use cookies in order to facilitate various social media buttons and/or plugins in this Platform.

How we may use your personal information



Referrers and Receivers

We use and disclose the personal information of Referrers and Receivers for the purposes for which the information is collected, or for a directly related purpose, including:

  • providing our website, products and services to you;
  • verifying your identity and place of work;
  • verifying your qualifications and registration with AHPRA and other professional associations;
  • verifying your medical provider numbers;
  • administering, protecting, improving or optimising our website, products and services (including performing data analytics, conducting research and for advertising and marketing purposes);
  • billing users for our products and services;
  • informing you about our website, products, services, rewards, surveys, or other promotional activities or events sponsored or managed by us or our business partners;
  • responding to any inquiries or comments that you submit to us;
  • to resolve any disputes and enforce our agreements and rights with third parties;
  • any other purpose you have consented to;
  • any use which is required or authorised by law; and
  • for any other purpose reasonably considered necessary or desirable by Consultmed in relation to the operation of our business.

We may disclose the personal information of Referrers and Receivers to:

  • our wholly or partly owned subsidiaries to provide you with additional products or services from these entities;
  • other Referrers or Receivers who are providing or receiving a referral or Advice & Guidance in respect of a Patient;
  • third parties we ordinarily engage from time to time to perform functions on our behalf for the above purposes and for the delivery of any products or services;
  • any person or entity to whom you have consented to us disclosing your personal information to;
  • anyone to whom part of all of our assets or businesses are transferred or sold;
  • our external business advisors, auditors, lawyers, insurers and financiers where necessary; and
  • any person or entity to whom we are required or authorised to disclose your personal information to in accordance with the law.

Patients  

We will disclose the health information of a Patient only as directed by the Referrer or Receiver providing health services to that Patient, in accordance with the express consent of that Patient, or as required to do so in accordance with the law.

We do not sell or share personal information with third party marketers.

Direct Marketing



Referrers and Receivers

From time to time, we may send to Referrers and Receivers news, information and offers relating information about products and services we believe are suited to you and your interests or we may invite you to attend special events. Your personal information may also be collected so that Consultmed can promote and market products and services to you. This is to keep you informed of our services and any special offers we believe you will find valuable and may continue after you cease acquiring products and services from us. If you would prefer not to receive promotional or other material from us, please let us know and we will respect your request. You can unsubscribe from such communications at any time if you choose, by following the instructions in the relevant marketing communication or by contacting us in writing.

Patients and/or Carers

No health information will be used to market directly to Patients and/or Carers. All health information is stored securely in an anonymised format, and our staff and service providers will not have access to such information except in very limited, exceptional circumstances.

When we may disclose your personal information



Information provided to suppliers

When you acquire or access any other services from a third-party supplier (including Hosts) through this Platform, we will provide to that supplier such information as is necessary to enable it to process and administer your order. Such information will include personal information about you, including (without limitation) your name and contact details.

Information provided to other organisations

In order to deliver the services you require or for the purposes set out above, Consultmed may disclose your personal information to organisations outside Consultmed. Your personal information may be disclosed to these organisations only in relation to this Platform, and Consultmed takes reasonable steps to ensure that these organisations are bound by confidentiality and privacy obligations in relation to the protection of your personal information.

These organisations may carry out or provide:

  • customer enquiries;
  • mailing systems;
  • billing and debt-recovery functions;
  • information technology services;
  • marketing, telemarketing and sales services;
  • market research; and
  • website usage analysis.

In addition, we may disclose your personal information to:

  • your authorised representatives or legal advisers (when requested by you to do so);
  • credit-reporting and fraud-checking agencies;
  • credit providers (for credit-related purposes such as creditworthiness, credit rating, credit provision and financing);
  • our professional advisers, including our accountants, auditors and lawyers;
  • government and regulatory authorities and other organisations, as required or authorised by law;
  • organisations who manage our business strategies, including those involved in a transfer/sale of all or part of our assets or business (including accounts and trade receivables) and those involved in managing our business risk and funding functions; and
  • the police or other appropriate persons where your communication suggests possible illegal activity or harm to others.

Contacting us about privacy


If you would like more information about the way we manage personal information that we hold about you, or are concerned that we may have breached your privacy, please contact us by email to helpdesk@consultmed.co. We will respond to you within a reasonable period of time to acknowledge your complaint and inform you of the next steps we will take in dealing with your complaint.

If you are not satisfied with our response, you may complain to the Office of the Australian Information Commissioner (OAIC) via the OAIC website, www.oaic.gov.au.

Access to your personal information

Subject to some exceptions provided by law, you may have access to personal information that we hold about you. We will handle requests for access to your personal information in accordance with the Australian Privacy Principles. All requests for access to your personal information must be directed to the Privacy Officer by email using the email address provided above or by writing to us at our postal address. We will deal with all requests for access to personal information as quickly as possible. Requests for a large amount of information, or information that is not currently in use, may require further time before a response can be given. We may charge you a fee for access if a cost is incurred by us in order to retrieve your information, but in no case will we charge you a fee for your application for access.

In some cases, we may refuse to give you access to personal information that we hold about you. This may include circumstances where giving you access would:

  • be unlawful (e.g., where a record that contains personal information about you is subject to a claim for legal professional privilege by one of our contractual counterparties);
  • have an unreasonable impact on another person’s privacy; or
  • prejudice an investigation of unlawful activity.

We may also refuse access where the personal information relates to existing or anticipated legal proceedings, and the information would not be accessible by the process of discovery in those proceedings.

If we refuse to give you access, we will provide you with reasons for our refusal.

Controlling your personal information

At any time when you are required to fill in a form on the Platform, you may select the box to indicate that you do not want to receive marketing communications from Consultmed, nor do you want your Personal Information to be used for direct marketing purposes. If you have previously agreed to us using your Personal Information for direct marketing purposes and change your mind at a later time, you may request to opt out of same by writing to us at helpdesk@consultmed.co.

Correcting your personal information

If you believe that we hold any personal information that is out of date, you may request that your personal or health information be amended. We will respond to your request to correct your personal or health information within a reasonable timeframe. We will need to verify your identity before responding to your request. If we decide to refuse your request, we will tell you why in writing and how to complain.

Storage and security of your personal information



Transmission of Information

We are committed to maintaining the confidentiality of the information that you provide us and we will take all reasonable precautions to protect your personal information from unauthorised use or alteration. When transmitting personal information via the Platform, you must keep in mind that the transmission of information over the internet is not always completely secure or error-free.

Notwithstanding this, we have implemented industry standard processes to protect personal information and health information from unintended disclosure, misuse and loss. This includes a number of physical, administrative, personnel and technical measures, including by:

  • storing all our cloud information in Australia and on approved servers;
  • storing all health information in an anonymised and encrypted format;
  • restricting the external transmission of personal and health information;
  • adopting measures to protect our computer systems and networks for storing, processing and transmitting personal and health information;
  • adopting procedural and personnel measures for limiting access to personal information by our staff and contractors;
  • restricting our staff and service providers from accessing health information, except in exceptional circumstances and with the oversight of senior management;
  • regularly reviewing and updating our information collection, storage and usage practices;
  • using password protection, multifactor authentication procedures and physical access restrictions to limit unauthorised access;
  • complying with laws applicable to the collection, use, transmission and storage of personal and health information; and
  • regularly testing our systems and networks and assessing security risks.

We may hold your personal or health information in either electronic or (in rare circumstances) hard copy. We take reasonable steps to protect all personal and health information from misuse, interference and loss, as well as unauthorised access, modification or disclosure. These steps include robust administrative, and technical safeguards that are regularly reviewed and updated. Whilst no system can guarantee complete security, we are committed to continuously improving our practices to safeguard your information.

The Download and/or Export of Information

Should you wish to download or export personal or health information from the Platform, you will be required to sign a Data Export Liability Waiver, acknowledging the inherent risks associated with such actions. By signing the Data Export and Liability Waiver, you will represent and warrant that you have obtained all necessary authorisations to access, manage, and transfer the information in full compliance with applicable organisational policies, procedures, and legal requirements. The Platform accepts no liability for any loss, damage, cost, or expense arising from or in connection with the download or export of information from the Platform.

Storage upon termination

Following termination of your use of the Platform for whatever reason, your account will be closed and you will no longer be able to send or receive Referrals or Advice & Guidance through the Platform.  However, you will be provided access to the Platform for sixty (60)  days after the date of termination to view and download or export  Referrals,  Advice & Guidance, and all other data, including but not limited to sensitive and confidential Patient and/or Carer data, for your records.

Following the termination of any Account on the Platform, all data associated with the Account, including but not limited to all sensitive and confidential Patient and/or Carer data, will be permanently deleted after a period of sixty (60) days in accordance with applicable privacy laws, including the Privacy Act 1988 (Cth) and the Health Records and Information Act 2002 (NSW) . The Account holder is solely responsible for ensuring that all required data is downloaded or exported prior to its permanent deletion.

Upon termination of an Account, the Account holder will be required to sign a Liability Waiver confirming their responsibility to download, export, and secure all required data from the Platform within sixty (60) days. Any data not retrieved within this period will be permanently deleted and cannot be recovered. The Platform accepts no liability for any loss, damage, cost, or expense resulting from the Account holder’s failure to secure their data before deletion.

Suspected data breach
